    About

    The Women at Risk (subclass 204) visa is a permanent humanitarian visa designed specifically to protect women who are in danger of persecution, violence, or gender-based abuse and who do not have the protection of an adult male.

    Eligibility for this Visa

    • The applicant must not live any male person over 18 years old (whether, husband, brother or any other relative
    • The applicant must not have any relative residing in the same locality

    This condition means the applicant must be completely without the support and presence of an adult male in her daily life and surroundings.

    Sponsor Limitation for Spouse/Partner

    This is one of the most important restrictions mentioned in your text.

    If a women granted the subclass 2004 visa, you can not propose or sponsor a spouse or de-facto partner for five years. After 5 years, if you wish to sponsor your spouse, you must do so through the Family Stream of the Migration Program.

    The 5-year limitation mainly applies when:

      • The relationship was not disclosed to immigration authorities.

    Important Note: The sponsor must not be an unlawful maritime arrival who arrived on or after 13 August 2012.

    How to Apply

    According to Australian immigration authorities, there is no separate, dedicated form for subclass 204. Instead, the following forms are required:

      1. Form 681 (Proposal Form) – Completed and signed by the proposer/sponsor in Australia.
      2. Form 842 (Application for an Offshore Humanitarian visa) – Completed and signed by the visa applicant.

    There is some important note that applicant must follow them;

      1. the applicant must prove;
        • Degree of persecution
        • Connection to Australia
        • No other suitable country for resettlement
        • Australia’s capacity to receive them
      1. Lifetime sponsorship limit: A person can sponsor a maximum of 2 people as spouses or partners in their lifetime.
      2. Processing priority: Subclass 204 has high priority within the Humanitarian Program.
      3. Location requirement: The applicant must be outside Australia at the time of application and decision, and also living outside their home country.
